Terms and Conditions
Retention of Title
All goods remain property of BLUE FIRE FORGE until payment is made in full.
All goods shall be at the buyer’s risk as from delivery save and except damage caused by BLUE FIRE FORGE or sub-contractors hired by BLUE FIRE FORGE.
In spite of delivery having being made, property of goods shall not pass from BLUE FIRE FORGE until;
– The client has paid the price in full and
– No other sums whatsoever shall be due from the client to BLUE FIRE FORGE.
If the price is not paid in full when such monies are due, BLUE FIRE FORGE expressly reserve the right to remove goods (entering the customer’s property if necessary) and to terminate the contract by giving seven days written notice of their intention to invoke the clause. BLUE FIRE FORGE shall exercise their right of removal in a workman like manner but shall not be liable for any loss, damage or inconvenience caused as a result of such removal. This clause does not affect BLUE FIRE FORGE’s statutory rights.
Payment Terms and Conditions
The price shall be the BLUE FIRE FORGE quoted price as stated in the invoice.
Prior to the commencement of any works by BLUE FIRE FORGE, the client shall pay a deposit of 50% of the price. The deposit is non-refundable.
Payment of the balance of the price shall be due on the day all works are completed or upon the day specified on the invoice, or immediately if;
The client cancels the contract within 7 days of the agreed completion date or/ BLUE FIRE FORGE have complete the manufacture of the goods.
Completion of the goods is delayed by the client, sub-contractors in the employ of the client or by circumstances under the client’s control.
Completion is prevented or delayed by the client failing to obtain all necessary planning, building or conservation consents required by any regulatory body, government or law.
BLUE FIRE FORGE will endeavor to remedy any defects or faults drawn to their attention at the time of completion within 7 days. The balance of the price will be immediately payable upon the completion of any such works. Any further faults reported will be deemed by BLUE FIRE FORGE as extra work and will make an extra charge as appropriate, unless otherwise stated.
Interest on overdue invoices shall accrue from the date when payment becomes due. The first 2 weeks after the due date will incur a £200 per week charge. Thereafter from day to day of payment there will be a further charge at a rate of 5 percent above the NATWEST Bank’s base rate from the time in force and shall accrue at such a rate after as well as before any judgment.
Product Design
The Goods shall be manufactured, supplied and installed (where appropriate) in accordance with the description and drawings agreed at the time that the invoice is signed and the deposit paid. BLUE FIRE FORGE reserves the right to make any changes or alterations in the specifications of the goods which are required to comply with any safety or statutory requirements, or which do not materially affect the quality, appearance or finesse of the goods. In the event that substantial alterations are required, BLUE FIRE FORGE will inform the client (where at all possible) before commencing such works reserving all rights to adjust any previous quote(s) formerly given.
BLUE FIRE FORGE Guarantees
BLUE FIRE FORGE guarantees that advice, service and workmanship in the manufacturing of goods will accord with a high standard of professionalism. All work will be guaranteed for a period of 12 months from date of installation/delivery against ‘wear and tear’ and general use.
However, BLUE FIRE FORGE cannot guarantee the following;
– Fixtures of our goods to existing stone, woodwork, masonry or any other existing surface(s).
– Ground subsidence or ground slip.
The Painted finish of any of our goods (including possibility of corrosion). Ironwork will require some ongoing maintenance by the client (such as repainting). BLUE FIRE FORGE can provide an aftercare plan for goods upon request.
Vandalism, Act of God, Thief, and/or injury to Property or Persons unless caused by BLUE FIRE FORGE.
Notice to Customers
The Deposit received by BLUE FIRE FORGE will be used to buy materials and cover any necessary expenses incurred by ourselves whilst carrying out the contract. It in no way alters the approximate timescale, given at the time the order is placed (this including any pre-paid contracts). BLUE FIRE FORGE reserves the right to alter the approximate time scale, due unforeseen circumstances at the time the order is placed, by a maximum of 30 days.
Upon the confirmation of the work to commence the client(s) do hereby accept these aforementioned terms and conditions and will abide them. Any alterations unto the acceptance of the terms and conditions shall be written and agreed upon by all parties before any work commences. If an agreement to these alterations cannot be met BLUE FIRE FORGE shall immediately refund the deposit minus the costs of any materials and other charges they deem appropriate.
